Grove Privacy Policy

DivX, LLC (“DivX”) is committed to protecting your privacy. We have prepared this Privacy Policy to describe to you our practices regarding the Personal Information (as defined below) we collect from users of Grove.

This Privacy Policy, together with our Terms of Service, governs your use of Grove. Capitalized terms not defined in this Privacy Policy have the meaning given in our Terms of Service.

1. User Consent.

By accepting the terms of this Privacy Policy, either by clicking a box indicating your acceptance or by accepting other terms, such as the Terms of Service and the Beta Program Agreement, which refer to this Privacy Policy, you expressly consent to the processing of your Personal Information in accordance with this Privacy Policy.

2. The data we collect and use.

“Personal Information” means data that allows someone to identify or contact you or your household, including, for example, your name, address, telephone number, e-mail address, IP address of your computer or Internet Service Provider (ISP), as well as any other nonpublic information about you that is associated with or linked to any of the foregoing information.

When you participate in one of our surveys, we collect your survey responses.

Information that identifies, relates to, describes, or is capable of being associated with, a particular individual, including, but not limited to, his or her name, signature, social security number, physical characteristics or description, address, telephone number, passport number, driver’s license or state identification card number, insurance policy number, education, employment, employment history, bank account number, credit card number, debit card number, or any other financial information, medical information, or health insurance information.

When you register for an account, we collect Personal Information from you, such as your first and last name, e-mail address, and password.

When you contact us via email, we collect your name and e-mail address, as well as any other content included in the e-mail, and any information that you submit to us.

Commercial information (e.g., records of personal property, products or services purchased, obtained, or considered, or other purchasing or consuming histories or tendencies).

Our email newsletter uses single-pixel or transparent image HTML-based emails, which allows us to track how many people open the emails we send out. Our email newsletter also uses a Facebook Pixel, a web analytics service provided by Facebook Inc., to help track website traffic. This information is only collected if you subscribe to our email newsletter.

Geolocation data

When you create and upload content to Grove, we collect location data to display your video in Grove.

Audio, electronic, visual, thermal, olfactory, or similar information

When you create and upload content to Grove, we store your videos in our servers.

When you contact us via telephone and leave a voicemail, our system records your voicemail.

You can decline to provide us with your Personal Information, however this may limit your ability to access certain features of Grove. To provide a safe and enjoyable experience for our users, some areas of Grove are accessible only while logged into an account. We will inform you at the point of collecting information from you whether you are required to provide the information to us.

3. How and Why We Use Your Personal Information.

The laws in some jurisdictions require companies to disclose their legal grounds for the collection, use, or disclosure of your Personal Information. In general, we only use your Personal Information if we have a proper reason for doing so, for example:

  • To comply with our legal and regulatory obligations;
  • For the performance of our contract with you or to take steps at your request before entering into a contract;
  • For our legitimate interests or those of a third party; or
  • Where you have given consent.

A legitimate interest is when we have a business or commercial reason to use your information, so long as this is not overridden by your own rights and interests.

4. Who We Share Your Personal Information With.

We share Personal Information with:

  • Our affiliates, including any parent company, subsidiaries, joint ventures, or other companies under a common control with the Company (collectively, “Affiliates”);
  • Service providers we use to help deliver our products and/or services to you, such as payment service providers, online store fronts, marketing agencies, or forums;

We only allow our service providers to handle your Personal Information if we are satisfied they take appropriate measures to protect your Personal Information. We also impose contractual obligations on service providers relating to ensure they can only use your Personal Information to provide services to us and to you.

We may disclose and exchange information with law enforcement agencies and regulatory bodies to comply with our legal and regulatory obligations or to protect the rights or property of the Company or users of the Services.

We may also need to share some Personal Information with other parties, such as potential buyers of some or all of our business or during a re-structuring. We will typically anonymize information, but this may not always be possible. The recipient of the information will be bound by confidentiality obligations.

6. Where Your Personal Information is Processed.

The Company is based in the United States. Your Personal Information may be processed in the country in which it was collected and in other countries, including the United States, where laws regarding processing of Personal Information may be different than the laws in your country.

7. Cookies.

“Cookies” are small pieces of information that a website sends to your computer or device’s hard drive while you are viewing a website or app. Persistent Cookies can be removed by following your Internet browser or device’s help file directions. If you choose to disable Cookies, some areas of Grove may not work properly.

We use Cookies on Grove as follows:

You can opt out of Facebook and other participating companies’ Cookies and other advertising tracking tools through the Digital Advertising Alliance in the US, the Digital Advertising Alliance of Canada in Canada, or the European Interactive Digital Advertising Alliance in Europe or through your mobile device settings. Please note ad blockers and tools that restrict cookie use may interfere with these controls.

8. Integrity and Retention of Your Personal Information.

We aim to make it easy for you to keep your Personal Information accurate, complete, and up to date. You can update your account information as needed through the account settings menu or by sending an e-mail to us at divx-support@divx.com. We will retain your Personal Information for the period necessary to fulfill the purposes outlined in this Privacy Policy unless a longer retention period is required or permitted by law.

9. Your Choices Regarding Your Personal Information.

We offer you choices regarding the collection, use, and sharing of your Personal Information:

Grove: If you have registered for Grove, you may revoke your consent to the collection and use of your Personal Information at any time by Contacting Us. Please note that upon erasure of your Personal Information, you will permanently lose access to all DivX services, registered devices, user data and content, and purchased content from prior to the erasure date. You will also lose all history of purchases and any support cases completed prior to the erasure date.

Newsletter: If you have signed up for our newsletter, we will periodically send you free newsletters and e-mails that directly promote the use of Grove, the purchase of our software products and may contain advertisements for third party companies. When you receive newsletters or promotional communications from us, you may indicate a preference to stop receiving further communications from us and you will have the opportunity to “opt-out” by following the unsubscribe instructions provided in the e-mail you receive or by contacting us directly at privacy@divx.com. Should you decide to opt-out of receiving future mailings, we may share your e-mail address with third parties to ensure that you do not receive further communications from third parties. Despite your indicated e-mail preferences, we may send you notices of any updates to our Terms of Service or Privacy Policy.

10. Changes to Your Personal Information.

You may change any of your Personal Information in your account by editing your profile within your account or by sending an e-mail to us at divx-support@divx.com. You may request deletion of your Personal Information by us, but please note that we may be required to keep this information and not delete it (or to keep this information for a certain time, in which case we will comply with your deletion request only after we have fulfilled such requirements). When we delete any information, it will be deleted from the active database, but may remain in our archives. We may decline to process requests that are unreasonably repetitive, require disproportionate technical effort, jeopardize the privacy of others, are extremely impractical, or for which access is not otherwise required by applicable law.

11. Your Rights Under the CCPA.

You have the right under the California Consumer Privacy Act of 2018 (CCPA) and certain other privacy and data protection laws, as applicable, to exercise free of charge:

  • Reidentify or otherwise link any data that, in the ordinary course of business, is not maintained in a manner that would be considered Personal Information; or
  • Provide the Personal Information to you more than twice in a 12-month period.

Personal Information Sold or Used for a Business Purpose

In connection with any Personal Information we may sell or disclose to a third party for a business purpose, you have the right to know:

If you exercise your right to opt-out of the sale or disclosure of your Personal Information, we will refrain from selling your Personal Information, unless you subsequently provide express authorization for the sale of your Personal Information.

Right to Deletion

Subject to certain exceptions set out below, on receipt of a verifiable request from you, we will:

  • Delete your Personal Information from our records; and
  • Direct any service providers to delete your Personal Information from their records.

Please note that we may not delete your Personal Information if it is necessary to:

  • Complete the transaction for which the Personal Information was collected, fulfill the terms of a written warranty or product recall conducted in accordance with federal law, provide a good or service requested by you, or reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform a contract between you and us;
  • Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity; or prosecute those responsible for that activity;
  • Debug to identify and repair errors that impair existing intended functionality;
  • Exercise free speech, ensure the right of another consumer to exercise his or her right of free speech, or exercise another right provided for by law;

  • Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when our deletion of the information is likely to render impossible or seriously impair the achievement of such research, provided we have obtained your informed consent;
  • Enable solely internal uses that are reasonably aligned with your expectations based on your relationship with us;
  • Comply with an existing legal obligation; or
  • Otherwise use your Personal Information, internally, in a lawful manner that is compatible with the context in which you provided the information.

You have the right to not be discriminated against by us because you exercised any of your rights under the CCPA. This means we cannot, among other things:

  • Deny goods or services to you;
  • Charge different prices or rates for goods or services, including through the use of discounts or other benefits or imposing penalties;
  • Provide a different level or quality of goods or services to you; or
  • Suggest that you will receive a different price or rate for goods or services or a different level or quality of goods or services.

Please note that we may charge a different price or rate or provide a different level or quality of goods or services to you, if that difference is reasonably related to the value provided to our business by your Personal Information.

12. Keeping Your Personal Information Secure.

The Company is committed to protecting the security of your Personal Information. We use a variety of industry-standard security technologies and procedures to help protect your Personal Information from unauthorized access, use, or disclosure. We also require you to enter a password to access your account. Please do not disclose your account password to unauthorized people. Despite these measures, you should know that Company cannot fully eliminate security risks associated with Personal Information and mistakes may happen.

15. Privacy of Minors.

We do not intentionally gather Personal Information about visitors under the age of 13. If a parent or guardian becomes aware that his or her child has provided us with Personal Information such parent should Contact Us at privacy@divx.com. If we become aware that a child under 13 with Personal Information, we will take reasonable steps to delete such Personal Information from our files.

16. Changes to this Privacy Policy.

This Privacy Policy is subject to occasional revision in accordance with the Terms of Use. We will notify you by means of a notice on Grove and/or via email prior to any changes becoming effective.
